Key Stages

With every property purchase there are key milestones.  The precise path of a purchase will vary according to individual circumstances, but typical key stages are as follows:

  • Taking your instructions and give initial advice based on the information you have provided
  • Checking finances are in place to fund the purchase and contacting the lender’s solicitors if needed
  • Receiving and advising on contract documents
  • Undertaking searches
  • Obtaining further planning documentation if required
  • Making any necessary enquiries of the seller’s solicitor
  • Providing advice on all documents and information received
  • Advising you of the mortgage offer conditions
  • Finalising contracts and sending necessary documents to you for signature
  • Agreeing a completion date (the date from which you will legally own the property)
  • Exchanging contracts and notifying you that this has happened
  • Ensuring all monies have been received from you and the lender(s)
  • Completing the purchase
  • Dealing with submission of the Stamp Duty Land Tax return and payment of Stamp Duty Land Tax (if any)
  • Completing and submitting an application for registration at the Land Registry and any other post completion formalities.

Purchases with a mortgage

We are happy to act for an institutional mortgage lender who instructs us in relation to a property purchase for no additional charge.

Additional costs and disbursements

We are required to conduct Anti-Money Laundering (AML) checks against all clients.  We use a commercial service provider for these checks and pass on a cost of £9 incl. VAT per client to you.  For example, if you are a couple purchasing a property, there is a cost of £18 incl. VAT added to the total fee.

Disbursements will have to be paid for any sale or purchase of property.  The usual disbursements for a freehold property purchase calculated on basis of a purchase price of £400,000 are:

Specialist purchase searches may also be required, for example if the property is on land that was previously used for mining. If these additional searches are needed, the cost of each search varies.  We will inform you if one or more specialist searches are required and an estimate of the cost of these as soon as possible.

For a leasehold property purchase, additional disbursements will be payable upon completion such as Notice of Transfer fee and/or Deed of Covenant charge payable to a Management Company or the Freeholder.  We will provide you with an estimate of these once the information is received from the seller’s solicitor.

Disbursements will be itemised on our invoice to you and will usually be payable together with our fee at the end of the sale or purchase.

Changes to our fees

Occasionally we have to carry out additional work which we could not reasonably have anticipated at the outset.  If this is the case, we will inform you immediately, provide a fair estimate of the additional fee and ask you to confirm the instruction.

Examples include:

  • If the property is not registered with HM Land Registry
  • Where you buy with a Help to Buy ISA: a fixed fee of £50 plus VAT.

Stamp Duty Land Tax or Land Transaction Tax - (Wales)

Cancellation of instructions

Our fee is calculated to cover all the work required to deal with your purchase.  If the purchase is abandoned or if you cancel our instructions for any other reason before completion, we will charge a fair fee that covers the work carried out by us up to that point.
